We collect personal information that you voluntarily provide to us when you register for an account, place an order for subscriptions, express an interest in obtaining information about us or our products, or otherwise when you contact us. The personal information we collect may include the following:

  • Account Credentials: Full legal name, corporate email address, username, and password (stored in encrypted form).
  • Contact Information: Mobile phone number and office address (for support and operational dispatch).
  • Professional Identity: Job title (Driver, Fleet Manager, Site Administrator), Employee ID, and Driver's License Number for professional verification and legal compliance.
  • Financial & Billing Data: Subscription billing records, company GST/Tax identification numbers, and billing addresses for invoice generation. All payment card details are processed exclusively by our payment processor, Razorpay, and are never stored on EKA Mobility servers.
  • User-Submitted Media: Profile photographs, proof-of-delivery images, and vehicle damage documentation photographs uploaded within the platform.

B. Information Automatically Collected

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, and information about how and when you use our Services.

  • Precise Geolocation Data: We collect live location to show assigned vehicle position, calculate optimal navigation routes, record trip history ("Daily Trails"), enable geofence alerts, and optimize fleet logistics. This data is collected continuously—including when the application runs in the background or the screen is turned off—to ensure active driver dispatching, safety tracking, and accurate driver scoring.
  • Device Telemetry: Device hardware name, manufacturer, model, operating system version, Unique Device Identifier (IMEI/UUID), and network carrier information to ensure platform compatibility and security.

  • EV Telematics Data: Data transmitted from EKA electric vehicle onboard systems, including battery state of charge (SoC), battery health and temperature, real-time charging status, estimated remaining range, energy consumption (kWh per trip), motor diagnostics, and regenerative braking data. This data is generated automatically by EKA EVs and is the primary operational dataset used by the Eka Connect platform for fleet management, predictive maintenance scheduling, and Total Cost of Ownership (TCO) analysis.
  • Professional & Employment Data: Trip records, mission logs, fleet assignment records, delivery confirmations, and driver performance data generated during the use of the platform in a professional capacity.
Critical Disclosure — Background Location Tracking Eka Connect collects precise GPS location data continuously, including when the app is closed or running in the background, to enable real-time tracking of EKA electric vehicles, route history ("Daily Trails"), geofencing alerts, and mission audit trails. This is a core operational feature of the EKA EV fleet management platform, disclosed at the time of installation. We collect live location to show assigned vehicle position, calculate optimal navigation routes, and track fleet driver styles. Background location collection is essential to compile driving telemetry and provide active roadside support even when the driver's phone is locked. Users may withdraw consent by disabling location permissions in device settings (Settings > Privacy > Location Services on iOS, or Settings > Apps > Eka Connect > Permissions > Location on Android), though this will prevent the proper functioning of the Service.

C. Information We Do NOT Collect

We are committed to data minimisation. The following categories of data are explicitly not collected by EKA Mobility:

  • Raw credit or debit card numbers (handled exclusively by Razorpay).
  • Biometric data such as fingerprints or facial geometry (device biometric authentication is processed locally by the device OS and is never transmitted to or stored on our servers).
  • Audio or video recordings, thermal imaging, or sensory data, unless explicitly submitted by you.
  • Education records or student data (excluding basic identification tracking mandated in B2G school bus contracts).
  • Consumer profiling inferences for behavioral advertising or marketing.
  • Health or medical data.
  • Social media account data (we do not support social login).
In Short: We process your information to provide, improve, and administer our Services; to communicate with you; for security and fraud prevention; and to comply with applicable law. We process your information only when we have a valid legal reason to do so.

We process your personal information for the following purposes:

  • To detect and prevent fraud: Monitoring for suspicious login activity, GPS spoofing attempts, and unauthorised data access to protect the integrity of the platform and client assets.
  • To improve our Services: Using anonymised and aggregated analytics data to identify usage trends, feature gaps, and performance bottlenecks to improve the platform for all clients.
  • To comply with legal obligations: Retaining records as required by Indian tax law, audit requirements, and responding to lawful government or court orders.
  • To fulfil contractual obligations: Our service is delivered pursuant to an agreement with the Client; processing your data is inherently necessary to fulfil our end of that contract.

B. Lawful Basis: B2C vs B2G Contexts

Depending on your role and your organisation, our lawful basis for processing varies:

  • Business-to-Consumer (B2C): For individual consumers using our fleet services, we process data based on your explicit consent. You may withdraw this consent at any time (see "Your Rights" below).
  • Business-to-Government (B2G): For government fleet customers (e.g., municipal transport, official vehicles), data processing is governed by the service agreement with the Agency based on contractual necessity, statutory duty, and public interest. The Agency establishes the legal basis to share data with us.
  • Business-to-Business (B2B): For commercial fleet operators, processing is based on contractual obligations to deliver the requested services.

C. Data Breach Notification

In the event of a personal data breach, we maintain incident response protocols to promptly notify affected users and regulators as required by law. This includes notifying relevant authorities within mandated timelines (e.g., within 72 hours under GDPR and the India DPDP Act, and within 6 hours to CERT-In) and informing affected individuals as soon as practicable or without undue delay.

In Short: We share data only with specific, vetted service providers who help us operate the platform. We do not sell your data. We do not share your data with advertisers, marketing brokers, or business partners for commercial gain.
We do not sell your personal data. EKA Mobility does not sell, rent, lease, or trade personal information to any third party for monetary or non-monetary consideration. Data is shared exclusively to operate, maintain, and improve the Eka Connect platform.

We may share your personal data with the following categories of service providers, each of whom is bound by data processing agreements and confidentiality obligations:

We may also disclose your personal information in the following limited circumstances:

  • Legal Compliance: When required to comply with a legal obligation, court order, subpoena, or government authority request, in accordance with applicable law.
  • Protection of Rights: When disclosure is necessary to enforce our Terms of Service, protect the safety of any person, or prevent fraud and illegal activity.
  • Business Transfers: In connection with any merger, acquisition, reorganisation, sale of assets, or transition of our business or a portion thereof, where personal data may be transferred as a business asset, subject to the same privacy commitments herein.
  • With Your Consent: In any other circumstances where you have provided explicit prior consent for a specific disclosure.
In Short: We use cookies, beacons/pixels/tags, and the Google Maps Platform APIs to collect and store information. We do not use advertising, targeting, or social media cookies.

We use the following tracking technologies:

  • Session Cookies: Used to maintain secure, authenticated user sessions between the driver mobile app and the web-based fleet management dashboard. These cookies are strictly necessary for the functioning of the platform.
  • Google Maps Platform APIs: We use Google Maps APIs which may load mapping tiles, request the device's GPS location, and set identifiers to render vehicle routes and asset positions on the interactive map. By using Eka Connect, you agree to be bound by the Google Maps Platform Terms of Service.
  • Razorpay Identifiers: Our payment gateway, Razorpay, may use session identifiers and security tokens during the checkout process to prevent fraud and authenticate transactions.

We do not use social media cookies, cross-site tracking cookies, remarketing pixels, or any advertising-network cookies. Users on supported browsers may configure cookie preferences via browser settings; however, disabling essential cookies will impair platform functionality.

In Short: Eka Connect does not support social media logins. All authentication on the platform is handled via corporate credentials managed through the EKA Identity Service.

All accounts on Eka Connect are created using a corporate email address and password, or Single Sign-On (SSO) credentials provided by the organisation's IT administrator. We do not integrate with Facebook Login, Google Sign-In (as an authentication method), Apple ID (Sign in with Apple), or any other social media authentication provider. This design decision ensures the highest possible security standard for our B2B enterprise clients.

In Short: Our primary data centres are in India. Some third-party services (Google) process data in the United States and globally. We implement Standard Contractual Clauses (SCCs) for any cross-border transfers of personal data, navigation logs, and telemetry from the EU, UK, India, or other regulated jurisdictions.

EKA Mobility's primary application infrastructure and data storage are located in India. To perform real-time navigation rendering, geocoding, route optimization, and vehicle tracking services, we share precise GPS coordinates and technical device identifiers across borders with global service providers (such as Google Maps API servers located in the United States and other global regions).

If you are accessing the service from the European Union (EU), United Kingdom (UK), South Africa, Australia, New Zealand, or any other jurisdiction, please be aware that your personal data and telemetry may be transferred to and processed in India, the United States, or other international jurisdictions where data protection laws may differ. We implement the following strict safeguards for international and cross-border data transfers:

  • Standard Contractual Clauses (SCCs): We rely on the European Commission's Standard Contractual Clauses (SCCs) as the primary legal mechanism for transferring personal data, GPS locations, and telemetry from the EU/EEA, UK, and other regulated regions to India and the United States. These clauses are incorporated into our data processing agreements with third-party service providers including Google and AWS.
  • Data Processing Agreements (DPAs): We have entered into formal Data Processing Agreements with all our third-party service providers (listed in Section 3) requiring them to maintain contractual obligations equivalent to the level of data protection applicable to your jurisdiction.
  • Security Standards: All transfers are conducted over encrypted HTTPS/TLS 1.3 channels, and stored data is encrypted at rest within our infrastructure to prevent unauthorized access.

We are not registered under the US-EU Data Privacy Framework (DPF) as this framework applies specifically to US-based organisations, and EKA Mobility is incorporated in India.

In Short: We keep your information for as long as necessary to fulfil the purposes described in this policy. For fleet and billing records, this is aligned with professional audit and legal retention cycles.

We retain personal information in accordance with the following schedule:

  • Account & Identity Data: Retained for as long as your account is active. Upon account closure, data is retained for up to 7 years (84 months) to comply with legal, tax, and financial reporting obligations.
  • Geolocation & Trip History Data: Precise GPS logs, Daily Trail records, and mission audit data are retained for the duration of the active fleet session and in historical archive for up to 7 years (84 months). Google Maps Location Caching

We cache precise latitude and longitude coordinates obtained via the Google Maps Platform API for the duration of the active fleet trip, and maintain this data in historical logs for up to 84 months (7 years) for legal and audit compliance. This caching is disclosed in accordance with Google Maps Platform usage policies.

In Short: We do not knowingly collect data from or market to children under 18 years of age.

Eka Connect is a professional B2B fleet management platform intended exclusively for use by adults in a professional or commercial capacity. The operation of commercial vehicles requires a valid driving licence which, under Indian law and most global jurisdictions, requires the holder to be an adult. Accordingly, our Services are not directed at, marketed to, or designed for minors under 18 years of age.

We do not knowingly collect personal information from children without verified parental consent. If our services extend to minors (e.g., B2G school bus tracking), we handle such data in strict compliance with applicable laws (like COPPA or the DPDP Act). If we become aware that we have collected personal information from a person under 18 years of age without proper consent, we will take immediate steps to deactivate the account and delete the associated personal data from our systems. Parents or guardians can request deletion of a child’s data by contacting us immediately at info@ekamobility.com.

In Short: Most browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature. We currently do not alter our data collection and use practices in response to DNT signals as there is no finalized uniform industry standard.

Most web browsers and some mobile operating systems and mobile applications include a "Do-Not-Track" (DNT) feature or setting you can activate to signal your privacy preference not to have data about your online activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

Global Privacy Controls (GPC): We currently do not process Global Privacy Control signals as we have not implemented the required technical infrastructure. We will update this notice if GPC support is added in the future.

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws and to reflect changes in our data practices.

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated "Last Updated" date at the top of this notice, and the updated version will be effective as soon as it is accessible. For faster resolution, please include "Privacy Request" in the subject line of your email and provide your registered account email address.

In Short: Based on the applicable laws of your country, you may have the right to request access to, correction of, or deletion of the personal information we hold about you.

You may exercise your data rights in the following ways:

  • Request Account Deletion (Within the App / Support): Because accounts are administratively provisioned by your employer or fleet administrator, users cannot delete accounts directly in an automated manner. To request permanent account deletion and de-identification of personal data, open the Eka Connect application, navigate to Settings > Account > Request Account Deletion (which will assist you in sending a pre-formatted email deletion request to info@ekamobility.com), contact your organization's Fleet Administrator, or email us directly at info@ekamobility.com.
  • Data Export (Portability): To export your personal profile details and trip-telemetry logs in a structured, machine-readable format, navigate to Settings > Account > Request Data Export in the mobile app, or contact our support team at info@ekamobility.com.
  • Profile Updates (Within the App): For regular account details such as name, email, and phone number, you may update your profile directly within the Eka Connect application settings at any time.
  • Via Your Fleet Administrator: Many operational data rights relating to your role, trip history, and fleet assignment may be managed by your organisation's Fleet Administrator within the Admin Dashboard.
  • By Contacting Us Directly: For other privacy requests, please contact us at info@ekamobility.com with the subject line "Data Request — [Your Request Type]".

We will review and respond to all submitted data requests within 30 days of receipt, in accordance with applicable law. Please note that certain requests may be subject to exceptions, including our legal data retention obligations described in Section 7 (e.g., maintaining transaction records for tax compliance or anonymized fleet data), and we will inform you if any exception applies to your request.

This application uses the Google Maps Platform APIs. By using Eka Connect, you agree to be bound by the Google Maps Platform Terms of Service and the Google Privacy Policy.

  • Our Maps Platform implementation accesses user device location information for the purpose of placing vehicles on a map and calculating routes.
  • We obtain (or request) the user's location data with knowledge and consent at the time of onboarding.
  • We cache precise latitude/longitude coordinates retrieved via the Google Maps API:
    • During a trip: For the full duration of the active fleet mission.
    • In historical logs: For up to 84 months (7 years) for legal, insurance, and audit compliance in the logistics industry.

This use of Google Maps is consistent with Google's Maps Platform Acceptable Use Policy for professional logistics and fleet management applications.
